Spouse Visa
Every country has its own rules and regulations for obtaining Spouse visa. For instance in Australia, if you have married to a permanent resident of Australia then you become eligible for Spouse visa. A spouse is a lawfully wedded wife or husband. This visa legally allows you to enter Australia. You are also eligible if you are in serious relationship with an Australian citizen for a minimum of 12 months. Your spouse is allowed to sponsor you for 2 years. After 2 years if your relationship still holds, then you can apply for permanent residence.
You can be eligible for spouse visa in Australia if you have committed to lead a shared life with your spouse as wife and husband. It does not matter if you are not legally married. What matters is the commitment to shared life. You are also eligible if your relationship is continuing and genuine and you live with your spouse. You also don't live separately or stay apart on permanent basis. You will get spouse visa if your partner is ready to sponsor you. You both need to be more than 18 years old. You also need to be passing the health criteria. Spouse visa allows you to work in Australia. During that period, you can also study in Australia but access to scholarships and government funding is denied. You are also entitled for medical benefits.
Spouse visa does not cost much. There is application charge for spouse visa. This money is not refundable if your application is rejected or you withdraw the application.
In United States you can have either an immigrant spouse visa or a non immigrant visa. If you have American citizenship and you want your foreign spouse to come to United States then your spouse should apply for immigrant or non immigrant spouse visa to come to United States. Non immigrant spouse visa will be given in the country where your marriage took place. You should also have a domicile i.e. residence in United States before the immigration department issues a spouse visa. You may not be eligible for spouse visa if you are involved in drug trafficking or you are suffering from an incurable disease like AIDS or Cancer. If you are practicing polygamy, or submitting fraudulent documents then also you won't be eligible for spouse visa.
